
PRIVACY POLICY
Preamble
MOGAMAC is committed to protecting the privacy of individuals and legal entities that share personal data with it, striving continuously and uncompromisingly to earn the trust of data subjects in this area.
This applies to the processing of personal data of data subjects residing in the territory of the European Union.
Article 1.
Personal data processing is understood as any personalized communication technique that uses personal files, databases or banks, with a view to establishing an interactive relationship with all individuals who contact MOGAMAC , with a well-defined objective.
Article 2.
The purpose of this document is to provide information about the way in which MOGAMAC collects, uses and shares the personal information of all individuals and legal entities that contact it, the options available to them in this regard and how they can access and correct this information if necessary.
This Policy has been developed to comply with the requirements of current privacy protection legislation.
Article 3.
1st The entity responsible for processing personal data is MOGAMAC.
2nd MOGAMAC has appointed a data protection officer who can be contacted directly by letter sent to MOGAMAC , Rua Jacinto Galvão nº27, 5200-235 Mogadouro, or by email at departamento@mogamac.com.
3. We have developed and implemented internal policies and procedures designed to adequately protect the personal information in our possession, and both are reviewed regularly.
Article 4.
1. We train our employees on the importance of protecting personal information through training sessions and guidelines issued on a regular basis, which emphasize the role they play and their respective obligations in this regard.
2. We take reasonable steps to ensure that our agents, representatives, suppliers and other external organizations comply with this Policy.
Article 5.
1º For the purposes of this Policy, they refer to any information that allows the identification of an individual or a legal entity, such as name, address, tax identification number, email address, telephone contact, curriculum vitae or any medical or financial information.
2. We collect your personal information in various ways, including when you place an order or simulation on our online pages or participate on our social media pages.
3rd The personal data to which we have access within the scope of our activity are processed because they are necessary for the conclusion and execution of the order, to comply with legal obligations imposed on MOGAMAC , to pursue legitimate interests of MOGAMAC or because they were the subject of express consent. The omission or inaccuracy of such data or other information provided to MOGAMAC by the individuals who contact it are their sole responsibility.
4. Personal data provided by individuals or generated by the use of the service will be processed and stored electronically, and are intended to be used by MOGAMAC for: dissemination of its activity to potential customers, market analyses and surveys, to understand the needs, interests and preferences of customers and inform them about services, benefits, equipment, promotions or features that may be of interest to them, to control the quality of our activity and improve the service, for accounting, tax and administrative management, litigation management, revenue protection and auditing, network and systems management, control of information security and physical security, and compliance with legal obligations.
5. Data processing for the purposes of disclosing orders and similar matters will be carried out in accordance with the consent option expressed by the interested parties. Consent must be prior, free, informed, specific and unequivocal, expressed in a written or oral statement or by validating an option. Individuals may object to the processing of data for the purposes of disclosing activities at any time and by any means.
6. Personal data are kept for different periods of time, depending on the purpose for which they are intended and taking into account legal criteria, necessity and minimization of the retention time. In particular, they will be kept for the purposes of complying with legal obligations and protecting the legitimate interests of MOGAMAC or for the legally defined periods for the purposes of investigation and legal proceedings of a criminal nature, after which they will be anonymized.
7. In the case of personal data forwarded for recruitment purposes or commercial orders, personal data will be kept for a maximum period of 2 (two) years. In all other cases, personal data will be kept for a maximum of 10 (ten) years, a period that MOGAMAC considers sufficient to fulfill the purposes.
8th After the conservation period, all personal data collected will be anonymized or deleted.
9º MOGAMAC is not responsible for the use or sharing of personal information provided by individuals to third parties, and cannot be held responsible for their policies, procedures or practices with regard to the protection of personal information.
Article 6.
1. We have implemented a combination of material, organizational and technological means to guarantee the confidentiality of the personal information we hold, in order to protect it against loss or theft and to prevent any unauthorized access, transmission, reproduction, use or editing thereof, and also to safeguard the principle of proportionality in access to information, imposing access profiles, which guarantee the principle that access to personal data is determined, justified and limited to the need to know it.
2nd When we share personal information with third parties, when it results from a legal or guardianship obligation, we take appropriate security measures to ensure that the entity in question complies with the commitments and rules established in this Policy,
3rd Your personal information will be stored on servers to which only MOGAMAC has access, notwithstanding the provisions of article 8.
Article 7.
1º Upon written request and proof of identification, the data subject may consult his/her personal information collected, used or shared by us, as required or permitted by law.
2nd Access and rectification are free.
3. We will attempt to process requests for access to or rectification of personal information, when not via the MOGAMAC portal, within thirty (30) days of receipt. If it is not possible to respond within this period, the individual applicant will be notified.
4. We make every effort to ensure that the personal information in our possession is correct, complete and up to date. However, the data subject is in the best position to inform us promptly of any changes to his or her personal information. Therefore, we ask that you inform us of any necessary corrections.
5. The data subject may request that appropriate corrections be made to the personal information held by us. If applicable, we will forward the rectified information to the third parties that have access to your personal information.
6º Any comments, questions or requests for access or rectification regarding the data subject's personal information, this Policy or our internal procedures for protecting personal information should be sent to MOGAMAC's Personal Data Protection Officer (DPO).
7. All individuals who share personal data with MOGAMAC are guaranteed the right to object, erase, limit and transfer their personal data. The exercise of these rights can be requested through the addresses listed above.
8º The fulfillment of a legal obligation, which requires MOGAMAC to keep them, or for reasons of public interest, constitutes an exception to the duty to forget.
Article 8.
MOGAMAC may use subcontractors for the purposes of processing personal data, in particular for customer management, service provision, billing and litigation management, and these entities are obliged to develop appropriate technical and organisational measures to protect data and ensure the defence of the rights of the data subject. In certain circumstances, certain personal data may have to be communicated to public authorities, such as the tax authorities, courts and security forces.
Article 9.
Our WEBSITE and social networks are not aimed at minors under the age of 13, so we request that these minors do not provide us with personal data through the WEBSITE, social networks or emails.
Article 10.
1st MOGAMAC asks that you do not send us or make us aware of any sensitive personal data, that is, information that reveals racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, except for the purposes of benefiting from special conditions of access to our services, genetic information, biometric information, data relating to health or data relating to a natural person's sexual life or sexual orientation.
2nd These personal data will be immediately deleted.
Article 11.
This Policy is subject to amendments to keep up with rapidly evolving rules regarding the protection of personal information and privacy.
